Sign the Minor Waiver

1. Consent to Participate

I am the parent or legal guardian of the minor participant named in this Agreement. I give permission for the minor participant to participate in the FC Softball Tournament at Northfield Park on June 27, 2026.

2. Acknowledgment and Assumption of Risk

I understand that softball and related tournament activities involve inherent and foreseeable risks, including but not limited to falls, collisions, being struck by balls, bats, equipment, or other participants, field or weather conditions, heat-related illness, sprains, fractures, concussions, cuts, bruises, serious injury, permanent disability, or death.

I understand that these risks may arise from the minor participant's actions, the actions of other participants, coaching, officiating, spectators, equipment, playing surfaces, premises conditions, weather, transportation around the event area, or other circumstances connected with the tournament.

On behalf of myself and, to the fullest extent permitted by Texas law, on behalf of the minor participant, I knowingly and voluntarily accept and assume the risks connected with the minor participant's participation in the tournament.

3. Waiver and Release of Liability

IN CONSIDERATION OF THE MINOR PARTICIPANT BEING ALLOWED TO PARTICIPATE, I, ON BEHALF OF MYSELF, MY HEIRS, REPRESENTATIVES, SUCCESSORS, AND ASSIGNS, RELEASE AND DISCHARGE NORTH TEXAS BOOSTER CLUB AND ITS OFFICERS, DIRECTORS, MEMBERS, VOLUNTEERS, AGENTS, REPRESENTATIVES, SPONSORS, AFFILIATES, TOURNAMENT ORGANIZERS, COACHES, UMPIRES, STAFF, AND ANY PROPERTY OWNERS OR FACILITY OPERATORS INVOLVED WITH THE FC SOFTBALL TOURNAMENT FROM CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, COSTS, OR EXPENSES ARISING OUT OF OR RELATED TO THE MINOR PARTICIPANT'S PARTICIPATION IN THE TOURNAMENT, INCLUDING CLAIMS BASED ON THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES, TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW.

This release does not apply to claims that cannot legally be released under Texas law, including claims based on gross negligence, willful misconduct, or intentional misconduct to the extent such claims may not be released by law.

4. Indemnity and Hold Harmless

I agree to indemnify, defend, and hold harmless North Texas Booster Club and the other released parties from claims, demands, damages, costs, attorney's fees, or liabilities arising out of or related to the minor participant's participation in the tournament, except to the extent prohibited by Texas law.

5. Medical Authorization

If the minor participant is injured or becomes ill during the tournament and I cannot be reached, I authorize tournament representatives to seek emergency medical care for the minor participant. I understand that I am responsible for any medical expenses incurred.

6. Parent/Guardian Representation

I represent that I am the minor participant's parent or legal guardian, that I have authority to sign this Agreement, that the minor participant is physically able to participate except as disclosed below, and that I have read this Agreement carefully and understand that I am giving up certain legal rights.

7. Governing Law and Severability

This Agreement shall be governed by the laws of the State of Texas. If any portion of this Agreement is found unenforceable, the remaining portions shall remain in effect to the fullest extent permitted by law.
